Please read this policy carefully to understand Qualifi Technologies, Inc.’s policies and practices regarding your information and how we will treat it. By accessing or using the Services, you agree to this privacy policy; if you do not agree with our policies and practices, your choice is not to use the Services.
Unless otherwise defined herein, capitalized terms used in this policy have the meaning set forth in the Customer Terms and Conditions set forth [here], and such Customer Terms and Conditions are incorporated herein by reference.
1. Introduction
1.1 We respect your privacy and are committed to protecting it through our compliance with this policy. Any information provided to us in any manner by any Customer will be covered by this Privacy Policy, including information collected from you or that you may provide when you visit the Application Services (such as when you communicate with us through mobile or desktop applications or similar platforms, or when you communicate with us via email, text, or other electronic means of communications).
1.2 We reserve the right to change this policy at any time. Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by means of posting a notification on our website or by other means. It is your responsibility to review this site and this policy periodically and to be aware of any modifications.
2. The Information We Collect.
2. We collect different types of information about you, including information:
A. by which you may be personally identified, such as your name, postal address, e-mail address, telephone number, Internet Protocol (IP) address, or any other identifier (“Personal Information”);
B. details of your visits to the Application Services, including traffic data, location data, logs, referring/exit pages, date and time of your visit, error information, and other communication data and the resources that you access and use on the Application Services; and
C. information about your computer and internet connection, including your IP address, operating system, and browser type.
The above may collectively be referred to herein as “Information,” including Personal Information.
3. How We Collect Information.
Generally, we collect Information directly from you when you provide it to us, and automatically as you navigate through the Application Services. Below are examples of how we may collect Information from you.
3.1 We may collect Information from you when you create an account or a profile on the Application Services, and when you provide information about yourself as part of an interview process through the Application Services. This includes information provided at the time of registering to use the Application Services, subscribing to any of our Services, posting any material, or requesting further services from us. We may also ask you for information when you enter a contest or promotion sponsored by us; when you report a problem with our Application Services; and when you respond to surveys that we might ask you to complete for research purposes.
3.2 We may work with third parties to monitor and provide analyses of certain data, including browsing patterns, by tracking non-personally identifiable information about our visitors. Such third parties may include, for example, but are not limited to Google Analytics, Google AdWords, and Facebook. Each third party may also set forth their own policies which may be binding on you or may affect the use of your data.
3.3 Information may be obtained through the use of cookies, which are files with a small amount of data which may include an anonymous unique identifier. We use both session cookies and persistent cookies. Cookies are sent to your browser from a website and stored on your device that can later be retrieved to identify you to us. To give you the best online experience possible we may use cookies or similar technologies; cookies make your use of the site easier, make the site run more smoothly, and help us to maintain a secure site. Cookies do not contain personally identifiable information; however, once you choose to enter our site with personally identifiable information that information may be linked to the data stored in the cookie. You expressly consent to the installation of cookies. After you leave our Site and App and close your browser or mobile application, a persistent cookie remains. However, you may be able to change your privacy preferences regarding the use of cookies and similar technologies through your browser. You are always free to decline our cookies if your browser permits, but some parts of our site may not work properly in that case. If you do not accept cookies, you may not be able to use some portions of the Services.
4. How We Use your Information.
4.1 We use your Information, including Personal Information, for various purposes described below, including:
A. to present our Application Services and their contents to you, and to provide you with information, products, or services that you request from us;
B. to provide you with notices about your account/subscription, including expiration and renewal notices, and to notify you about changes to the Application Services or any products or services we offer or provide;
C. to carry out our obligations to you, and enforce our rights arising from any contracts entered into between you and us;
D. in any other way we may describe when you provide the information, and for any other purpose with your consent.
4.2 With your consent, we may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. If you wish to consent to this use, please check the relevant box located on the form on which we collect your data. If you wish to change your choice, you may do so at any time by logging into the Websites and/or Apps and adjusting our user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request at contact@qualifi.hr.
5. How We May Disclose Your Information.
5.1 We do not sell your Personal Information to unaffiliated third parties. However, we may disclose your Information, including your Personal Information, to third parties, including:
A. With our subsidiaries and affiliates, and to contractors, service providers, and other third parties affiliated with us in order to continue to develop our Application Services, improve our Services, and provide the same to you;
B. As part of a transfer or assignment if we are acquired by, sold to, or merged with another entity, or otherwise reorganized or liquidated;
C. In response to legal process, court order, or government or regulatory request; to enforce other agreements with you, including for billing and collection purposes; and if we believe disclosure is necessary or appropriate to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of use, to verify or enforce compliance with the policies governing our sites and applicable laws or as otherwise required or permitted by law or consistent with legal requirements;
D. With credit card issuers and financial institutions in order to obtain payment from you, such that they may process payments and refunds, verify the absence of fraud, or assist in debt collection, in the course of the performance of a contract or on the basis of other legitimate interests;
E. With IT service providers (including IT platform provides and website analytic service providers) in order to provide the Services to you and to analyze your use of the Services, such that they may support our IT systems, provide hosting, processing and analyzing services with respect to information and data collected, and provide maintenance of such systems, in the course of the performance of a contract or on the basis of other legitimate interests;
F. With our agents and other service providers, in order for such entities to perform functions on our behalf, such as hosting, billing, notification, storage, content management, analytics, customer service, fraud protection, etc., in the course of the performance of a contract, on the basis of other legitimate interests, by legal obligation, or through your consent; and
G. If we believe that you may harm, or have harmed, our property or infringed upon our rights, or harmed the property or infringed upon the rights of other users or third parties, to report, disclose, limit, respond to, or prevent such conduct or activity. This includes exchanging information with other companies and organizations for the purposes of fraud protection.
5.2 You grant permission for us and our licensors to use, reproduce, copy, and publish Information which is not Personal Information, or is derived from Personal Information but which has been de-identified and aggregated such that it is no longer capable of identifying you, for any lawful purposes, including for our marketing purposes, and providing the same to unaffiliated third parties for marketing and selling their products and services.
5.3 Qualifi's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
6. Notice of Recording.
6.1 If you are participating in an interview on our Application Services that involves an audio component, it will be recorded and provided to the hiring party that advertised the employment opportunity to which you are applying, including any personal information you may choose to provide. By participating in an interview using our Application Services, you acknowledge that you have been informed that you may be recorded as part of the interview process. Further, by participating in an interview using our Application Services, you grant your irrevocable consent for Qualifi to provide any recording created through your use of the Application Services, in full and without prior review by Qualifi, to the hiring party that advertised the employment opportunity to which you are applying, and for any other legal purpose, subject to the terms of this policy.
6.2 All audio recordings of any interview you participate in using our Application Services, and any works derived therefrom, shall be the sole property of Qualifi or the hiring party that advertised the employment opportunity to which you are applying, as determined by Qualifi, and you waive any and all rights of publicity, privacy, or other rights therein. You further waive any and all rights to bring an action at law or equity related to such interview(s) against Qualifi, its successors, assigns, and licensees, and release them from any and all liability whatsoever. If you do not agree to the above terms or if you do not wish to be recorded, you should not participate in any interviews using the Application Services.
7. Children Under Age 18. Our Services are not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the Services. We do not knowingly collect Personal Data from children under 18. If you are under 18, do not use or provide any information via the Services or on or through any of their features, register or make an account via the Services, make any purchases through the Services, or use any of the interactive or public comment features we may offer. If we learn we have collected or received Personal Data from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from a child under 18, please contact us at contact@qualifi.hr.
8. Third-Party Services. Except as otherwise discussed in this policy, this policy only addresses the use and disclosure of Information we collect from you. Other sites accessible through our Services may have their own data collection, use, and disclosure practices. Please consult each site’s privacy policy and terms of use. We are not responsible for the policies or practices of third parties. Additionally, other companies that may place advertising on our Services may collect information about you when you view or click on their advertising through the use of cookies. We cannot control this collection of information. You should contact those advertisers directly if you have any questions about their use of the information that they collect.
9. Consent Revocation and Account Termination.
9.1 To the extent we rely on your consent to process any information, you may revoke that consent at any time (except to the extent we are required to retain the information for the limited purposes of completing a service you have requested). If you wish to revoke such consent, or if at any time you do not wish to receive communications stated herein from us, you may change your account settings or send your request to us via email. However, if you refuse to provide certain Information or withdraw your consent to our processing of certain Information, then in some cases we may not be able to provide certain services to you. For clarity, should you revoke such consent or opt-out at any time, we may continuously maintain and use, as set forth herein, any anonymized, de-identified, or aggregated data we collected during your use of the Services.
9.2 We will retain your Information for the entire time that you keep your account open. After you close your account, we may retain your Information:
A. for as long as necessary to comply with any legal requirement, to protect our legal interests, or otherwise pursue our legal rights and remedies; and
B. on our backup and disaster recovery systems in accordance with our backup and disaster recovery policies and procedures; and
C. for data that has been aggregated or otherwise rendered anonymous in such a manner that you are no longer identifiable, indefinitely.
10. Data Security
10.1 We have put in place industry-standard procedures to safeguard and help prevent unauthorized access, to maintain data security, and to correctly use the information we collect online. Unfortunately, we cannot guarantee that 100% of the data transmissions are secure. Therefore, while we strive to protect your personally identifiable information, you acknowledge that: (a) there are limitations to security and privacy of the internet that are beyond our control; (b) the security, integrity and privacy of your personally identifiable information exchanged between you and us cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party. For accounts that require payment, we may use a third-party payment processor to better ensure the security of your payment information. Such third-party processor may have its own terms and privacy policies. We recommend that you review such third-party policies when making a payment to us to understand the security measures such third-party has taken regarding your payment information.
10.2 The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
